ORDER

This Criminal Original Petition has been filed to set aside the order dated 18.10.2019 passed by the Learned Principal District and Sessions Judge, Tiruppur in Crl.M.P.No.1248 of 2019 in Crl.M.P.No.815 of 2019 in Crime No.24 of 2018.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

3. The petitioner is an accused in Crime No.24 of 2018 on the file of City Crime Branch, Tiruppur. Similarly, he was an accused in Crime No.336 of 2018 on the file of Saravanampatti Police Station, Coimbatore and Crime No.42 of 2019 on the file of CCB, Coimbatore.

4. While at the time of granting bail to the petitioner in Crl.M.P.No.815 of 2019 in Crime No.24 of 2018, the petitioner was directed to appear before the City Crime Branch, Tiruppur, daily twice at 10.00 a.m. and 5.00 p.m. Similarly, in respect of other two cases pending on the file of Saravanampatti Police Station, Coimbatore and CCB, Coimbatore, a bail order was granted on 09.09.2019 and 11.10.2019 respectively, on condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. and 5.00 p.m.

Only by considering the inconvenience having by the petitioner in appearing before the respondent police in all the cases, he filed an application before the Learned Principal Sessions Judge, Tiruppur in Crl.M.P.No.1248 of 2019 in Crl.M.P.No.815 of 2019 for relaxation of condition and the same was dismissed. Only in the said circumstances, he is before this Court for setting the said order.

Today, when the petition came up for hearing, the learned counsel for the petitioner would submit that in respect of Crime No.336 of 2018 and Crime No.42 of 2019, the condition imposed by the Judicial Magistrate Nos.II and VII, Coimbatore are relaxed, and therefore, the petitioner is willing to avail the condition imposed by the Learned Principal Sessions Judge, Tiruppur, in Crl.M.P.No.815 of 2019 in Crime No.24 of 2018.

7. In this regard, the Learned Additional Public Prosecutor appearing for the respondent police is agreed for considering the prayer sought for by the petitioner.

8. Accordingly, this Criminal Original Petition is allowed and the petitioner is directed to appear before the Inspector of Police, City Crime Branch, Tiruppur, daily twice at 10.00 a.m. and 5.00 p.m. and sign until further orders. If the petitioner is intended to modify the condition, it is for him to file a petition before the Learned Principal Sessions Judge, Tiruppur, in appropriate time.
