This Criminal Original Petition has been preferred to direct the second respondent to register the FIR based on the CSR No.1010 of 2022 dated 06.11.2022 and to file a final report within the stipulated time. 1/4

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.

3. The learned counsel for the petitioner submitted that the petitioner has given a complaint before the second respondent against one Raju and others on the allegation that he was assaulted by them; the petitioner had also produced the medical report so that he had taken treatment during the relevant point of time; but so far, no action has been taken.

4. The learned Government Advocate (Crl.Side) submitted that on the complaint given by the petitioner, enquiry has been initiated and the same has been closed as civil in nature.

5. In that case, notice of closure report should be given to the petitioner. If the petitioner is not satisfied with the closure report, the petitioner is at liberty to file appropriate proceedings by invoking Section 156(3) or 200 Cr.P.C., before the appropriate forum.

6. With the above observations, this Criminal Original Petition is disposed.
