This Criminal Original Petition has been filed, seeking a direction to the 1st respondent police not to execute the warrant issued in Ct Cases No.13458 of 2019 on the file of the Metropolitan Magistrate (NI Act) -03, Rouse Avenue Court Complex, New Delhi District.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents 1 & 2.

3. The learned counsel for the petitioner submitted that the petitioner is the first accused in CT Cases No.13458 of 2019 on the file of the Metropolitan Magistrate ( NI Act) -03; NBW has been issued to secure the accused in the said case; since the petitioner did not know the hearing date, he could not make his appearance; however, he would appear before the trial Court on 05.12.2022 without fail and hence the NBW should not be 2/4

executed.

4. The learned Government Advocate (Crl. Side) submitted that so far, the respondent police did not receive any NBW against the petitioner.
