No. 5721/ B2/ 2012, dated 2.7.2013, on the file of the 1st respondent and consequential Proc. No. 9688/ B2/ 2015-2, on the file of the 1st respondent, dated 1.2.2019, (in WMP.No.31035/2019) pending disposal of the above WP.No.30937/2019. Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M.
MURUGANANTHAM, Advocate for the petitioner and of on behalf of the Respondents the court made the following order:- Already the petitioner entered service as Technical Assistant on temporary basis and thereafter, he was promoted as a https://hcservices.ecourts.gov.
Technical Assistant Gr-I along with others including Respondents 4 and 5 vide proceedings dated 02.07.2013, wherein the respondents 4 and 5 were placed their Sl. Nos.5 and 6, whereas the petitioner was placed at Sl.No.7.
2. The grievance of the petitioner is that he should be placed over and above the respondents 4 and 5 being senior to them. While so, by impugned proceedings dated 01.02.2019, the respondents 4 and 5 were further promoted as Engineers. While the petitioner was declined promotion. Now challenging the impugned proceedings dated 01.02.2019 the petitioner also challenged the erstwhile proceedings dated 02.07.2013. Now in this petition the petitioner sought for interim stay of both the proceedings.
3. It is pertinent to note that the proceedings dated 02.07.2013, wherein, the respondents 4 and 5 and the petitioner himself also were promoted as Technical Assistant Gr-I and therefore at this distant point of time, the same cannot be stayed, and further it would affect the promotion of the petitioner also.
