C.M.P.No.29139 of 2023 in S.A.Sr.No.139993 of 2019 P.T.ASHA, J., The notice sent to the first respondent has been returned with an endorsement "Not claimed". It is also noticed that the Postman has attempted to serve the first respondent on five occasions and on the sixth occasion, the notice has been returned with the said endorsement.

Though notices have been served on the other respondents, they have not entered appearance. Therefore, there is a deemed service on all respondents.

2. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 130 days in filing the above appeal in S.A.Sr.No.139993 of 2019 is condoned.

3. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
