ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The allegation in this case is that on 20.06.2012, when the complainant was sitting in the mechanic shed, all the three accused joined together and abused him verbally. When the complainant tried to go away, the accused attacked him and he sustained injured. As such a case was registered in Cr.No.389 of 2012 dated 21.06.2012 for the alleged offence under Section Page No.1 of 4
294 (b), 324 and 506 (ii) I.P.C.
3.It can be seen that the final report was filed on 14.06.2013 and even at that time A1 and A3 was shown as absconding accused and A2 alone was apprehended even during the investigation. After the case was taken on file all the accused still remaining elusive and the warrant are pending against them. 4.Considering the nature of allegations, and the fact that these accused are not present on the spot and the problem also is no more persisting and thirteen years of time has since gone, no useful purpose will be served in keeping the matter pending. Any further continuance of the case would impinge upon the right to speedy trial of the accused. 5.Accordingly, the case in C.C.No.361 of 2023 of Judicial Magistrate Court, Sriperumbudur Taluk, Kancheepuram, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
