ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.In this case the incident was occurred on 11.03.2012. It is alleged that both the accused abused the complainant in filthy language and also caused grievous injury by hitting the complainant on his head by using an iron rod. As such a case was registered in Cr.No.84 of 2012 dated 11.03.2012 for the alleged offence under Section 294 (b) and 324 I.P.C. Page No.1 of 4

3.The accused are not found in the address. It is stated on behalf of the Police that despite best efforts, accused remain untraceable. It is also stated that the complainant is not in the said address and remains untraceable. There is no likelihood of any meaningful trial that can be conducted after thirteen years of the incident. Even if the accused is brought to face trial, it would impinge upon his right to speedy trial and no useful purpose would be served. 4.Accordingly, the case in C.C.No.397 of 2023 of Judicial Magistrate Court, Sriperumbudur Taluk, Kancheepuram, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
