Prayer in W.P.No.33179 of 2022: Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to disburse the interest for the petitioners acquired land situated at Irugur Village, Sulur Taluk, Coimbatore District bearing Patta No.2852 and 3117, comprised in S.F.No.278/1 measuring an extent of 1 acre 98 3⁄4 cents or 86638.71 sq.ft as per Section 12 of the Tamil Nadu Acquisition of Land for Industrial Purpose Act 1997 and consider his representation dated 19.08.2022. 2. The petitioner's land were acquired for public purpose under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. For the said acquisition from the petitioner admittedly the compensation has been paid which has been received by the petitioner. However, for the belated payment of compensation 12% interest can be charged which so far has not been calculated and paid to the petitioner. Therefore, in order to get such interest, the petitioner has given a representation on 19.08.2022 in respect of the two cases pertaining 2 / 4
to two different properties belonging to the petitioner. However, since the said representation has so far not been considered the petitioner has moved the present writ petition.
3. Heard the learned counsel for the petitioner who reiterated the aforesaid facts and would seek the indulgence in this writ petition.
4. Heard the learned Additional Government Pleader who would submit that the said representation given by the petitioner dated 19.08.2022 .would be considered and decided within a time frame that may be stipulated by this Court.
5. Considering the limited scope of the prayer sought for in this writ petition and the submissions made by the learned Additional Government Pleader appearing for the respondents, this Court is inclined to dispose of this writ petition with the following order.
"That there shall be a direction to the 3rd respondent to consider the representation dated 19.08.2022 given by the petitioner and pass orders thereon within a period of six weeks from the date of receipt of a copy of this order." R. SURESH KUMAR, J.
