ORDER

In this case, final report is filed complaining the offence punishable under Section 4 (1) Tamil Nadu Open Places (Prevention of Disfigurement) Act, 1959.

2. The allegations that are made is that in a manner as to spoil the serenity of the place, a flag of a VCK party has been painted in the wall of the Moorthiyan Bus Stop, Ariyalur violating the rules of the election. The final report was filed on 28.05.2019, and the accused have been facing trial since Page No.1 of 3

then. Thus, it can be seen that the allegations concern exercising the democratic right to protest. Given the context and nature of the allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case.

3. Accordingly, the proceedings in S.T.C.No.133 of 2020 on the file of Judicial Magistrate Court, No.II, Jayamkondam Taluk, Ariyalur, stands quashed and this Suo Motu Transfer case is disposed of. 26.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
