ORDER
This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.
2. This case is registered for alleged offences under Sections 379 r/w 34 of IPC. The incident occurred on 05.04.2017. The allegation is that when the defacto complainant was walking, all the four accused came from the opposite Page No.1 of 4
direction and by diverting his attention, one of the accused tried to steal the cell phone from the pocket of the defacto complainant. The defacto complainant caught hold of the accused and he gave the cell phone to the other accused and all the other accused started running, but however, the public overpowered all the accused and they were handed over. It can be seen that the cell phone was also recovered and handed over to the defacto complainant. The accused are facing the case from the year 2017 and they were also arrested and remanded to custody and thereafter they were let out on bail.
3. Considering the factual matrix, context of the case, continuing the case hereafter would impinge upon the right to speedy trial of the accused and no useful purpose will be served by keeping the matter pending.
4. Accordingly, the case in CC.No.849 of 2017 on the file of the VII Metropolitan Magistrate Court, George Town Taluk, Chennai stands quashed and this Suo Motu Transfer case is disposed of. 26.08.2025 rap electronically alone. The Trial Court shall take note of the order and Page No.2 of 4
accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
