ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. This occurrence happened in the year 2019. The allegation is that the accused stole two batteries from the tipper lorry. During the course of investigation, the silver which is taken out from the batteries were recovered and it is said to be handed over to the complainant. They were also remanded Page No.1 of 3

to custody and thereafter released on bail. It can be seen that they are facing the trial from the year 2019.

3. Considering the nature of allegations and the fact that there are no other antecedents against the accused, continuing with the trial would only impinge upon the right to speedy trial of the accused and accordingly, the case in CC.No.1167 of 2019 on the file of the Judicial Magistrate II, Salem Taluk, Salem stands quashed and this Suo Motu Transfer case is disposed of. 26.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
