ORDER

The allegation in this case is that the accused drove the vehicle in a rash and negligent manner and caused death. Hence, a case was registered on 30.01.2018 in Crime No.25 of 2018. Thereafter, Final Report was also filed on 15.12.2018. Though the matter is pending for the past seven years, the accused, who is said to be a resident of the village in Moradabad district in Uttar Pradesh, remains untraceable inspite of the best efforts of the Police. It is also brought to the notice of the Court that already, the dependent of the Page No.1 of 3

victim had also filed Claim Petition and the Tribunal also granted an award.

2. For all the above reasons, since the summons itself were not served, even if on a future date, if the accused are brought to books, there cannot be any meaningful trial and it will impinge upon the right to speedy trial of the accused.

3. Accordingly, the case in C.C.No.2254 of 2021 of XIV Metropolitan Magistrate Court, Egmore Taluk, Chennai, stands quashed. This Suo Motu Transfer Case is disposed of.

26.08.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
