ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegations against the accused in this case is that on 22.06.2017, the accused had robbed the mobile phone from the complainant and threw the same in the Adyar river. It can be seen that the accused was also arrested in this case and remanded to custody. After coming out on bail, till date, Page No.1 of 3

summons are not served. It is submitted on behalf of the Police that inspite of their best efforts, the addresses of both the accused could not be ascertained and the summons could not be served.

3. Considering the nature of offences and the fact that the accused also underwent custody and the case is pending for the past six years and no useful purpose will be served even if the accused is apprehended in future as the same would violate their speedy trial in the context of the case and no meaningful trial will be taken place.

4. Accordingly, the case in C.C.No.2807 of 2019 of XXIII Metropolitan Magistrate Court, Saidapet Taluk, Chennai, stands quashed. This Suo Motu Transfer Case is disposed of.

26.08.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
