ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case was registered for the alleged occurrence on 11.09.2005 in Cr.No.296 of 2005 for alleged offences under Section 379 of Indian Penal Code, 1860. It is reported that totally three accused in this case. The stolen property has been recovered and the same is handed over to the defacto complainant. Further it is reported that, A1 alone is attending the case and the matter is pending because, summons has not been served on A2 and A3. 1/2 https://www.mhc.tn.gov.in/judis

3. Considering the nature of allegation, the fact that A1 is facing the proceedings from the year 2005, even if the other accused are brought to face the trial, the same would impinge their right to speedy trial in the nature of the case and context of the allegations, no useful pupose would be served.

4. Accordingly, the case in C.C.No.200008 of 2017 of Judicial Magistrate Court No.II, Jayamkondam Taluk, Ariyalur is quashed and this Suo Motu Transfer Case is disposed of.

28.08.2025 stn electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
