The petitioner herein was secured on execution of a Non-Bailable Warrant in S.C.No.341 of 2021 due to his non-appearance. 1/4

The learned Government Advocate (Crl.Side) appearing for the respondent police, opposed the grant of bail to the petitioner and submitted that the trial is at an advanced stage. He further submitted that if the petitioner is released on bail, there is every possibility that he may abscond and jump bail. 3.

The learned counsel appearing for the petitioner submitted that the prosecution has failed to produce the records relating to the identification parade. As a result, the trial Court has taken action against the officials, who were responsible for producing the said records. In these circumstances, he submitted that the delay in progress of the trial is not due to the petitioner herein, but because of the prosecution's failure to produce the relevant record. 4.

Taking note of the facts and the conduct of the petitioner in abstaining from participating in the trial proceedings, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed for the present with liberty to the petitioner to approach the trial Court for appropriate relief at a later state, if there is any deliberate delay on the part of the prosecution in producing the relevant records. 02.09.2025 rpl To 2/4
