ORDER

This criminal original petition is filed to quash the proceedings in C.C.No.120 of 2017, pending trial on the file of the learned Judicial Magistrate No.1, Udumalpet.

2. When the matter is taken up for hearing, the learned counsel appearing for the petitioner arguing for a while, sought permission of this court to withdraw this petition with liberty to file necessary discharge application before the trial court. It is also stated by the learned counsel appearing for the petitioner that the so called bills said to have been forged, never produced before the trial court and it is open for the petitioner to raise all such defence before the trial court. At this stage, he also seeks the indulgence of this court, to https://hcservices.ecourts.gov.in/hcservices/

dispense with the personal appearance of the petitioner/accused before the trial Court.

3. Accordingly, this petition is dismissed as withdrawn with liberty to file necessary discharge application before the trial court. The personal appearance of the petitioner/accused before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., or on any other date as may be required by the trial Court. Consequently, the connected criminal miscellaneous petitions are closed.
