This writ petition has been filed for direction to respondents 1 & 2 to consider the representation submitted by the petitioner dated 05.08.2025 seeking order against the third respondent restraining from interfering with peaceful functioning of the petitioner's school. 2.

Heard the learned counsel appearing on either side and perused all the materials placed before this Court. 3.

It is seen that the petitioner is running a school for the past several years and it has hostel in the name of Periyar Kalvi Nilayam for both boys and girls. While being so, on a complaint lodged by some of the hostellers, a criminal case was registered in crime No.39 of 2025 for the offence punishable under Sections 5(f) & 6 of POCSO Act against the warden of the hostel. Now the petitioner has submitted the present representation seeking order restraining the third respondent from interfering with peaceful functioning of the school. However, admittedly when a criminal case has been registered and the same is pending for investigation against the petitioner's school, such representation submitted by the petitioner seeking order against the third respondent 2/4

cannot be considered. Therefore, this writ petition is liable to be dismissed.

Accordingly, this writ petition is dismissed. There shall be no order as to costs.
