O R D E R

This Criminal Original Petition has been preferred to direct the second respondent not to harass the petitioner to settle the landlord and tenant dispute by disturbing the business activities of the present tenant of the petitioner namely "MSS Travels" at No.140-A, Radha Rukmani Road, Egmore, Chennai - 600 008.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents.

3. The learned counsel for the petitioner submitted that on the complaint given by one Immanuel, the petitioner is being harassed by the second respondent police. It is further submitted that the dispute is between the tenant and the landlord and the complaint is purely civil in nature.

4. The learned Government Advocate (Crl.Side) submitted that on the said complaint, current paper enquiry has been initiated in CSR No.747 of 2022 and the enquiry will the completed within a short time.

5. In view of the above submission of the learned Government Advocate 2/4

(Crl.Side), the second respondent is directed to complete the enquiry within a period of four weeks from the date of receipt of a copy of this order. If the enquiry reveals that the matter is civil in nature, appropriate orders shall be passed on intimation to the parties. The second respondent is directed to follow the guidelines laid down by the Hon'ble Supreme Court in the case of Lalita Kumar Vs State of Uttar Pradesh & another reported in 2014 (2) SCC 1, while conducting enquiry.

6. With the above observations, this Criminal Original Petition is disposed.
