Respondents PRAYER : Writ Petition is filed under Article 226 of Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 6 to survey the property comprised in T.S. Nos.1931 and 1933, under Schedules F, G, H, I, and J Situated at Valliyammal Layout, Pollachi Town, Coimbatore District, and to fix the metes and bounds along with adequate police protection under the supervision of the 3rd Respondent, based on the applications on the petitioner dated 31.07.2025 within a stipulated time. The petitioner seeks for a direction to the respondents 1 to 6 to provide police protection.
2. Heard the learned counsel appearing for the petitioner and the learned Government advocate (Crl.Side) appearing for the respondents 1 to 6 and perused the documents placed on record.
3. According to the petitioner, the final decree has been passed in favour of the petitioner in O.S.No.46 of 2000 in I.A.No.1 of 2023 by the 2/4
learned I Additional Subordinate Judge, Coimbatore. The Commissioner, in fact, has inspected the property and filed a plan and the civil court has also passed a decree. In pursuant to the said measurements, when the petitioner tried to fence the property, the private respondent obstructed the same, hence the petitioner submitted a representation dated 31.07.2025 seeking police protection.
4. In such view of the matter, since the decree is operating in favour of the petitioner and the subject property has also been allotted to the petitioner in pursuant to the decree of the civil court, the respondents 1 to 6 are directed to provide necessary police protection to the petitioner. With the above direction, the Writ petition is disposed of. No costs. 28.08.2025 To
