This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 38 days in filing the above Criminal Revision Case against the judgment dated 28.03.2025 passed in Crl.A.No. 103 of 2023, on the file of Addl. District Judge (Fast Track Court), Mettur confirming the judgment dated 11.04.2019 made in S.T.C.No.1697 of 2019 on the file of Judicial Magistrate Court No.1, Mettur.

Mr.C.Prabakaran, learned counsel for petitioner submitted that as she is a senior citizen, she was suffered with age old ailments and also due to delay obtaining certified copy of judgment, she is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of August 2025, he gave papers to him, as a result of which, there is a delay of 38 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
