JUDGMENT

(Judgment of the Court was authored by R.SURESH KUMAR, J.) This intra-Court appeal has been directed against the order passed by the Writ Court dated 18.08.2021 made in W.P.No.17445 of 2016.

2. By the said order, the Writ Court allowed the said writ petition by giving a writ of mandamus, directing the second respondent therein, who is a appellant herein, to approve the appointment of one V.Jevitha as English Graduate Teacher in the respondent/writ petitioner School with effect from 12.08.2015 and directed to pay the salary and other monetary benefits without insisting passing of the Teachers Eligibility Test (TET).

3. As against the allowing of the said writ petition by the order dated 18.08.2021, though this appeal has been filed by the appellant State and the Department of Education, today, when the appeal is taken up for final hearing, Mr.J.C.Durairaj, learned Additional Government Pleader appearing for the appellants has stated that the order of the Writ Court, which is impugned herein, has already been complied with and in support of his contentions, he has produced a copy of the order passed by the District

Educational Officer (Primary Education) dated 18.07.2023, whereby, the appointment of the concerned Teacher has been approved.

4. This position is not controverted by Mr.R.Kamaraj, learned counsel for the respondent/writ petitioner.

5. In view of the said compliance, nothing survives in this writ appeal for further adjudication. Recording the same, this writ appeal is dismissed, having become infructuous. However, there shall be no order as to costs. Consequently, C.M.P.No.14026 of 2023 is closed.
