ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 26.01.2020, the accused drove the vehicle and caused injuries. The case was registered in Crime No.117 of 2022 for the alleged offences under Sections 279, 338 of Indian Penal Code, 1860 and r/w 181(3), 196 of Motor Vehicles Act 1988. 1/2 https://www.mhc.tn.gov.in/judis

3. When the matter was called, the accused was present and pleaded guilty. Considering the overall nature of the accident, the fact that the accused has been facing the case for a long time and that he has now pleaded guilty, this Court is of the view that a penalty of fine of Rs.200/- for the offence under Section 279 of IPC and Rs.300/- for the offence under Section 337 of IPC shall be imposed. The fine amount shall be paid by the accused on the next date of hearing before the Trial Court.

4. Accordingly, the case in S.T.C.No.636 of 2022 of Judicial Magistrate No.2, Bhavani Taluk, Erode is quashed and this Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
