PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records relating t the Criminal Case in S.T.C.No.2572 of 2017 on the file of the learned Judicial Magistrate, Bhavani, quashing the same by allowing this Criminal Original petition.

ORDER

The charge sheet in S.T.C.No.2572 of 2017, is under challenge in the present petition.

Today, when the matter is called, the learned counsel for the petitioner submitted that while pending the Criminal Original Petition, the trial has commenced and four witnesses have already been examined. At this stage, it would not appropriate to consider the grounds raised by the learned counsel for the petitioner for the purpose of quashing the proceedings.

In the above background, the Criminal Original Petition stands closed. Consequently, connected Criminal Miscellaneous Petitions are closed. The petitioner is at liberty to raise all the grounds raised in the present Criminal Original Petition before the trial Court.
