ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case, Cr.No.1989 of 2015 is registered for alleged offences under Section 294(b), 384, 506(ii) of Indian Penal Code, 1860. The occurrence is said to have happened on 19.06.2015. It is stated that the accused waylaid the complainant and threatened with knife and robbed two sarees from the defacto complainant.

It is stated that there is no other previous or subsequent case against both the accused. The accused remain elusive and of not traceable from the very filing of the final report. The defacto complainant also is not there at the present address and she also could not be traced. Under the circumstances, no meaningful trial is possible, even in the summon is served in the future date, the same will impinge upon the accused's right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in C.C.No.8854 of 2018 of XXIII Metropolitan Magistrate Court, Saidapet Taluk, Chennai is quashed and this Suo Motu Transfer Case is disposed of.

28.08.2025 stn electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
