The petitioner is an accused in Crime No.147 of 2023 had been registered for the offences under Sections 8(c) and 20(b)(ii)(C) NDPS Act seeks bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal side).

3.The petitioner had been remanded to custody on 06.07.2023. It is stated that on 28.06.2023, the respondent conducted check-up at Mankarai check post and found an Auto bearing Regn.No.TN 28-CU-7472 coming with two passengers. The driver was submitting his papers for being verified. At that time, the two passengers got into another Maruti car bearing Regn.No.KL 58 AC 9686. The Maruti car sped away from that place. On examining the CCTV, the respondent located the owner of the car and it was found that it had been given to the petitioner/A2. After the car was intercepted, the respondent found 20.450 kgs of ganja, which is commercial quantity and was seized. https://www.mhc.tn.gov.in/judis 1/2

gd 4.The 1st accused had also been arrested but the 3rd and 4th accused who were also in the car are still absconding. 5.The investigation can never commence, till the 3rd and 4th accused are secured. The quantity of ganja being commercial in nature, at this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
