G.Anthoni v. The Management

2023-03-15Honourable Mr Justice S. Vaidyanathan,Honourable Mrs Justice R. Kalaimathi2 pages

C.M.P. No. 20608 of 2022 in W.A.SR. No. 130847 of 2022 S. VAIDYANATHAN,J.

AND R. KALAIMATHI,J.

The above C.M.P. is filed to condone the delay of 1555 days in filing the writ appeal.

2.

Though we are not satisfied with the reasons stated for condoning the delay and the order of the learned Single Judge granting 50% backwages is also justified, in order to give a quietus to the matter, we are condoning the delay so that the appeal can be taken up on file and rejected as continuity of service and other benefits have not been deprived by the learned Single Judge for the purpose of arriving at terminal benefits and other benefits and only 50% of backwages have been deprived.

3.

Hence, the delay is condoned and the petition is ordered.
