The petitioner/A1 and A8, who were arrested and remanded to judicial custody on 04.06.2023 for the offences punishable under Sections 395 and 397 of IPC in S.C.No.222 of 2023 pending on the file of the Fast Track Mahila Court, Tiruppur connected to Crime No.94 of 2023 on the file of the respondent police, seek bail.

2.The 1st accused in S.C.No.222 of 2023 pending before the Fast Track Mahila Court, Tiruppur has filed Crl.O.P.No.25466 of 2023 and the 8th accused in the same Sessions Case has filed Crl.O.P.No.25501 of 2023. Originally, Crime No.94 of 2023 had been registered by the respondent under Section 395 and 397 of IPC.

3.It is the case of the prosecution that the defacto complainant while going to her fish shop at Kunnathur along with her husband and daughter, the petitioners along with other accused came in a white colour car and dashed against the defacto complainant's two wheeler and abducted the defacto complainant and her daughter. They then robbed both of their gold jewels and put them down in the road, after some distance. smv 4.The learned counsel for the petitioner states that other accused namely, A2, A3, A4, A5, A6, A11 and A12 had been granted bail by the trial Court.

5.However, on the side of the respondent very strong objection is raised stating that, test identification parade had been conducted and the present petitioners had been very specifically identified by the defacto complainant. It is also stated that trial has not commenced. 6.Let the trial commence. At this stage, I am not inclined to grant bail to the petitioners. Accordingly, these Criminal Original Petitions stand dismissed.
