Defendants Suit is filed under Section VII Rule 1 of Civil Procedure Code, 1908 and Order IV Rule 1 of Original Side Rules, to grant a judgment and decree (a) declaring that the resolutions / decisions taken at the Extra Ordinary General Meeting held on 24.04.2017 as illegal and contrary to law; (b) declaring the notice to hold the 32nd Annual General Body Meeting of the 1st Defendant on 07.10.2017 as illegal and contrary to law. (c) For a permanent injunction restraining the defendants their agents, men, representatives and assignees from in any manner conducting the 32nd Annual General Body Meeting on 07.10.2017 or on such other date and from acting on any resolution or decision that may heretofore be taken at such meeting.

Learned Counsel for the Plaintiff seeks permission of this Court to withdraw the suit with a liberty to file a fresh comprehensive suit against the Defendants for the same cause of action and he has also made an endorsement to that effect. 2.

Recording the same, the suit is dismissed as withdrawn with liberty to institute a fresh comprehensive suit against the Defendants for the same cause of action.
