2023-10-20Honourable Mr Justice C.V. Karthikeyan2 pages

Crl.OP.No.24394 of 2023 Crl.O.P.No.24394 of 2023 C.V.KARTHIKEYAN, J.

The petitioner who is arrayed as A3 seeks bail in P.R.C.No.67 of 2022 which is actually a split up case.

2.It is stated that as against A4, Non Bailable Warrant is still pending and as against the other accused namely A1, A2, A5, A6 & A7, S.C.No.236 of 2022 is now pending.

3.It is seen that Non Bailable Warrant was issued on 14.11.2022 and the petitioner was secured only on 12.09.2023. The trial can never progress if the accused take a decision to abscond themselves. 4.It is also seen that A4 has still not subjected himself to judicial process.

5.At this stage, this Court is not inclined to grant bail to the petitioner.

6.Hence, this Criminal Original Petition stands dismissed. 7.It is to be noted that the petitioner should remain under incarceration till completion of the trial.
