PRAYER:Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or any other appropriate Writ, Order or direction in the nature of Writ of Mandamus to issue suitable directions directing the 3rd respondent to release the original Sale deed/Pending document No.172/1996 executed in the name of the petitioner on 02.09.1996 in the Office of the Sub Registrar, Peelamedu, Coimbator, as per the petitioner's representation dated 02.08.2022 followed by a reminder dated 03.09.2022.

ORDER
The present petition has been filed seeking a direction to the 3rd respondent to release the original Sale deed/Pending document No.172/1996 executed in the name of the petitioner on 02.09.1996 in the Office of the Sub Registrar, Peelamedu, Coimbatore, based on the representation made my the petitioner on 02.08.2022followed by a reminder dated 03.09.2022. 2/6

It is the case of the petitioner that he had purchased Agricultural Nanja lands in Survey No.218 measuring to an extent of about 1 acre 42 cents and Survey No.551 to an extent of about 44 cents situated at Ramanathapuram vide the sale deed dated 02.09.1996 for a sale consideration of Rs.10,00,000/-, which deed was placed for registration before the 3rd respondent, however, the same is kept pending. Therefore, the petitioner made a representation dated 02.08.2022 to the respondents to release the sale deed. However, till date, no action has been taken on the said representation. Hence, the present petition has been filed.

Though very many grounds have been raised, however, learned counsel for the petitioners submitted that it would suffice if this Court issues a direction to the 3rd respondent to consider the representation dated 02.08.2022 made by the petitioner seeking to release the document and pass appropriate orders on the same, within the time that may be stipulated by this Court.
4. On the above contentions, this Court heard the learned Additional 3/6
Government Pleader appearing for the respondents who has no objection to the said order being passed.

In view of the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the 3rd respondent/Sub-Registrar to consider the representation dated 02.08.2022 made by the petitioner seeking to release the document and pass appropriate orders on the same in accordance with law, after affording an opportunity of personal hearing to the petitioner as well as to the aggrieved parties if any, within a period of Six weeks from the date of receipt of a copy of this order.
6. Accordingly, this Writ Petition is disposed of with the aforesaid direction. No Costs.
