ORDER

(Order of the Court was made by N.Sathish Kumar J.) This petition has been filed to suspend the sentence imposed on the petitioner/A2 by the learned III Additional District and Sessions Judge, Tirupathur, Tirupathur District, in S.C.No.148 of 2019 by judgment dated 07.07.2023 and for grant of bail. The petitioner/A2 was convicted of the offence under Section 302 IPC and sentenced to life imprisonment and fine of Rs.10,000/- in default to undergo three months simple imprisonment. 2.Challenging the conviction and sentence, A2 has filed the above appeal in Crl.A.No.547 of 2025 and sought for suspension of sentence and grant of bail.

3.Learned counsel for the petitioner/appellant would submit that P.W.1 to P.W.4 would not have witnessed the occurrence and they are only hearsay witnesses. He would further submit they have stated in the statement recorded under Section 161 Cr.P.C. that they were not present in the place of occurrence

at the relevant point of time. It is his further contention that the complaint (Ex.P1) has been created later to suit the case of the prosecution. Therefore, he would submit that he has a fair chance of success in the appeal and prays for suspension of sentence and bail.

4.On perusal of evidence, we are of the view that a prima facie case is made out for grant of bail to the petitioner. Since the appellant has arguable points in this appeal, which require detailed appraisal and further, since the appeal is not likely to be taken up in the near future, this Court is inclined to grant the relief of suspension of sentence and bail to the petitioner/A2. 5.Accordingly, the substantive sentence of imprisonment alone is suspended and the petitioner/A2 shall be released on bail on him executing a bond for a sum of Rs.25,000/- (Rupees twenty five thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Vaniyambadi, and on further conditions that:

(i) the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the learned Judicial Magistrate, Vaniyambadi, may obtain

a copy of their Aadhar card or Bank pass Book to ensure their identity. (ii) on release, the petitioner/appellant shall appear before the trial Court on the first working day of every month, until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.

6.Accordingly, this petition is ordered.
