ORDER

The petitioner has filed this Writ Petition praying for issuance of a Writ of Mandamus to forbear the first respondent from seizing the ornaments pledged by the respondents 2 and 3, which are with the writ petitioner.

2. The allegation is that respondents 2 and 3 have cheated the public and also pledged the jewels with the petitioner. The investigation is pending. Despite summons having been served on the petitioner, he is not co-operating for the investigation. Instead of co-operating for the investigation, the petitioner has rushed to this Court and had not approached this Court with clean hands. Therefore, this Court is not inclined to exercise the power under Article 226 of the Constitution of India.

3. Hence, this Writ Petition is dismissed. However, the first respondent is directed to pursue and proceed with the investigation in accordance with law. The petitioner is directed to co-operate for the investigation. There shall be no order as to costs.
