ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.
2. This case, Cr.No.590 of 2006 is registered for alleged offences under Section 302 of Indian Penal Code, 1860. This is an extraordinary case. The allegation in this case is that, the wife of the defacto complainant namely Revathi, who is the sole accused in this case is said to be a metally ill 1/4
person, who killed her own child. The occurrence happened on 25.12.2006. From thenon, the accused is also absent and she has gone away. A women missing complaint was also registered before the Jayamkondam Police and the mentally ill person is unable to trace out.
3. Mr. Ilangovan, the father of the child and the husband of the accused was produced before this Court virtually. Mr. Ilangovan would submit that, it is true that his wife was mentally ill and she has also gone away and she is yet to be traced for all these years. The matter is pending from the year 2006 onwards, there is no any prospect of the mentally ill person being traced out. Even if she is brought to books, no meaningful trial can hereafter be conducted in view of the efflux of the time and also the mental illness of the accused. He further states that the case can be closed.

In view of the above, since the offence is serious in nature, the case stands closed, however in future if the accused is traced out or if any clue is given to the police with reference to the whereabouts of the accused, liberty is granted to the prosecution to re-open the case and to conduct the case further, in accordance with law.

5. With the above observations, the P.R.C.No.100026 of 2007 of Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur is closed. Accordingly, the Suo Motu Transfer Case is disposed of. 28.08.2025 stn electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
