ORDER

This petition has been filed challenging the impugned order of the 2nd respondent dated 06.09.2024 and to quash the same.

2.The case of the petitioners is that they are adjacent land owners of the lands in Survey Nos.309/1 and 309/6 measuring an extent of 4.78.0 hectare in patta No.824 situated at No.169, Murugambakkam, Village, Jamin Endaththur, Madhuranthagam Taluk, Chengalpattu District. A quarry license was granted in favour of third parties in respect of the said land. Based on the public advertisement dated 28.03.2024, issued by the Village Revenue Inspector, Jamin Endaththur, Madhuranthagam Taluk the petitioners submitted their objections on 15.04.2024, 16.04.2024, 20.04.2024 and 29.09.2024 to the first respondent, requesting not to grant any permission to run quarry in the said land. However, the first respondent did not take any action. Hence, the petitioners filed W.P No.

13146 of 2024 before this Court, forbearing the respondents from granting a stone quarry licence to the 7th respondent, and this Court, by its order dated 09.05.2024, directed the respondents to consider the petitioners' representation. However, the petitioners' representation was rejected vide impugned order dated 06.09.2024. Challenging the same, the present writ petition has been filed.

3.The learned counsel appearing for the petitioners would submit that the first respondent, namely the District Collector has filed a counter affidavit, wherein it has been stated in paragraph 7 (v) that quarry leases will be granted

only after a receipt of report from the Revenue Divisional Officer, a technical report from the officials of the Mines Department and Environmental Clearance from the State Level Environmental Impact Assessment Authority. In view of the said submission, the learned counsel prayed that the writ petition may be closed.

4.Recording the aforesaid submission, this Writ Petition is closed. No costs. Consequently, W.P No.33014 of 2024 is closed. Further, W.P No.33013 of 2024 is ordered.
