2.Mr.King & Patridge, the learned counsel appears for the first respondent and he fairly submits that he has no objection to the delay of 109 days being condoned.
3.Though, second respondent is served with notice none appears.
4.In view of the submission made by the learned counsel for the first respondent, the delay of 109 days is condoned and the petition is accordingly ordered.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the matter along with C.M.A.No.2671 of 2022. Post on 26.04.2023.
