3. A. No.5758 of 2022 is to bring the applicants on record, who are the legal heirs of the deceased sole defendant as defendants 2 to 4 in T.O.S. No.41 of 2021.
4. Having satisfied with the reasons stated in affidavits filed in support of the applications, these applications are allowed. The delay of 34 days in filing the application to set aside the abatement, is condoned. Abatement set aside. Applicants/Legal heirs of deceased sole defendant, are impleaded as defendants 2 to 4 in the testamentary original suit.
