The petitioner who was arrested and remanded to judicial custody on 06.03.2023 for the offences punishable under Sections 8(c), 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 24(1) of the Cigarette Other Tobacco Products Act, 2003 in Crime No.55 of 2023 on the file of the respondent police, seeks bail. 2.It is the case of the prosecution that the petitioner was originally found in possession of 2.200 Kgs of Chocolate Ganja and on a confession, when the godown of the petitioner was searched, further 36.400 Kgs of Chocolate Ganja had been seized. The seized quantity is evidently commercial in nature.

3.The learned counsel for the petitioner stated that the petitioner had been in custody for nearly eight months.

4.Except for stating that the petitioner has been in incarceration for a considerable period of time, no further ground had been raised. It is stated that the investigation had been completed, but however, let trial continue. It is also seen that the petitioner is from the State of Bihar and there is every possibility of the petitioner absconding from this State. 1/2 https://www.mhc.tn.gov.in/judis

smv 5.Taking into consideration the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
