The defendant in the suit has presented this application for condonation of delay in filing the 17 documents listed and described in the schedule to the Judge's summons.

2. The suit is at the trial stage and the plaintiff's witness has been examined. Learned counsel for the plaintiff submits that the defendant is endeavouring to produce documents which were available at the time of filing of the written statement. It is further stated that the originals have not been produced.

3. Considering the fact that the defendant's evidence has not commenced, this application is liable to be allowed albeit subject to the right of the plaintiff to raise objections inter alia on grounds of admissibility, relevance and proof.
