ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.
2. This case is registered for alleged offences under Section 143, 294(b), 307, 506(ii) of Indian Penal Code, 1860 and Section 3 of Explosive Substances Act, 1998. The incident occurred in the year 2018. The complainant is appeared through video conference and states that she does not wish to pursue the case any further. The mother case in P.R.C.No. 15 of 2020 proceeded further and resulted in an acquittal. This case is pending only as against Page No.1 of 3
accused No. 4. The grounds for acquittal also apply to the present accused. The matter has been pending for the execution of the warrant since 2018.
3. Considering the factual matrix, the context of the case, the background of the accused, the reason for his absence at his place of residence, and the submission made that, despite best efforts, the warrant could not be executed, it is clear that even if the accused faces trial, no useful purpose would be served.
4. Accordingly, the case in P.R.C.No.23 of 2022 on the file of the XV Metropolitan Magistrate Court, George Town Taluk, Chennai shall stands quashed and consequently, this Suo Motu Transfer Case is disposed of. 08.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
