Manonmani v. Balasubramani

C.M.P.No.20635 of 2022 in C.M.A.SR.No.131124 of 2022 M.DHANDAPANI, J.

This petition is filed to condone the delay of 1952 days in filing the above civil miscellaneous appeal against the order in M.C.O.P.No.154 of 2016 dated 18.09.2017 on the file of the Motor Accident Claims Tribunal cum Additional Sub Judge, Mayiladuthurai.

2. In view of the endorsement made by the learned counsel for the petitioner/appellant, notice to the 1st respondent is dispensed with, since he remained ex-parte before the Tribunal.

3. Heard Mr.T.Gobinath, learned counsel for the petitioner/appellant and Mr.D.Baskaran, learned counsel, who takes notice on behalf of the 2nd respondent.

4. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is ordered.

5. It is made clear that the petitioner/appellant will not be entitled for any interest for the delay period of 1952 days.

6. Registry is directed to number the appeal, if it is otherwise in order and print the name of Mr.D.Baskaran as learned counsel for the 2nd respondent when the same is listed for admission.
