The petitioner is A4 in Crime No.249 of 2023 registered by the respondent police for the offences punishable under Sections 8(c) r/w w20(b)(ii)(B), 29(i) of NDPS Act, 1985.
2. It is stated that on 05.09.2023, when the respondent obtained information, they went to the Second Line Beach Road, where three persons were standing with a plastic bag. They were caught and searched. It is stated that the petitioner was in possession of 1.150 kgs of ganja. But, it is the case of the prosecution that it is the petitioner, who supplies the said ganja to the other accused for selling it in retail.
3. Investigation will have to be made as to the source from which, the petitioner gets the said ganja.
4. In view of the fact that the other accused are also in custody, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
