ORDER

This Suo Motu case is dealt with in an extraordinary manner by this Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. This case is registered for alleged offences under Sections 147, 353 and 506(1) of IPC, 1860. The incident occurred on 18.04.2016. The allegation in this case is that, when the officials went to the marriage hall for the purpose of executing distraint warrant, all these accused are said to have been remind inside the hall by locking the door and protesting the distraint proceedings and thereby preventing the officials from doing their official duty.

3. On the strength of the said allegation, some of the accused are facing the trial from the year 2016 and the summon itself is not served on the rest of the accused.

4. Considering the nature of the allegations continuing the case, any further would result in the right to a speedy trial. Due to passage of time, a meaningful trial is unlikely, and no useful purpose would be served. Page No.2 of 4

5. Accordingly, C.C.No.100030 of 2018 on the file of Judicial Magistrarte Court, Harur Taluk, Dharmapuri, stands quashed and this Suo Motu Transfer case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
