ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.

This Case in Cr.No.137 of 2015 is registered for the alleged offence under Sections 294 (b), 324, 323 & 506(ii) of Indian Penal Code. The defacto complainant is present. The parties would submit that they have since moved on and the matter has been compromised long ago and they do not Page No.1 of 3

want any further action be pursued in the matter. All the accused are also not residing in the respective address and in spite of the best efforts of the police, they could not be traced out. Initially, summons were not served and now the warrant is also not served. Under these circumstances, the specific request that is made by the defacto complaint not to proceed further and that they have compromised the matter, any further continuance of the proceedings will not result in any meaningful trial and as such no useful purpose will be served in keeping the matter pending.

Accordingly, the proceedings in STC.No.1960 of 2019 on the file of the learned Judicial Magistrate VII, Puducherry Taluk, Puducherry is quashed and this Suo Motu Transfer Case is disposed of. 01.09.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
