O R D E R
The Criminal Original Petition has been filed seeking for a direction to the learned Chief Judicial Magistrate and Special Judge, Tiruvannamalai to dispose the case in Spl.C.No.10 of 2020 within the stipulated period as fixed by this Court.
2. Learned counsel appearing for the petitioner submitted that the petitioner is working as a sanitary worker in Vettavalam Town Panchayat. The respondent has filed a final report against the petitioner and A1, S.Ganesan, Executive Officer, Kilpennathur Town Panchayat, Tiruvannamalai District. The case has been taken up on file in Spl.C.No.10 of 2020 and the case is pending from the year 2020. He further submitted that right to speedy trial is a constitutional guarantee and thereby, the present petition has been filed seeking to complete the trial within a stipulated time.
3. Learned Government Advocate (Crl.Side) submitted that the charge sheet was filed on 24.09.2020 and there are 32 witnesses listed in the charge sheet and the case now stands posted for examination of LW1 and LW2 on 2/4
27.11.2023. He also submitted that the respondent Police will be able to complete the trial within 6 months and hence he prayed that suitable order may be passed.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
5. Taking into consideration the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Criminal Original petition stands disposed of with a direction to the learned Chief Judicial Magistrate and Special Judge, Tiruvannamalai to complete the trial in Spl.C.No.10 of 2020 as expeditiously as possible, preferably, within a period of six months from 27.11.2023.
