3. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, C.M.P.No.24331 of 2023 is allowed.

4. Registry is directed to carry out necessary amendment and list S.A.No.772 of 2017 for hearing on 10.11.2023.
