ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This is an accident that occurred while executing contract work in the Moonglthurapattu Cooperative Sugar Mill on 30.01.2015. The matter has been pending for the past ten years. It is stated that the deceased was a migrant worker from Bihar State and that no family members are residing in Tamil Nadu. No particulars regarding whether any compensation was claimed could Page No.1 of 3

be gathered. The contractor, who was shown as the accused, is also from Bihar and has since returned to his native place. Despite best efforts, summons could not be served. The matter is still at the fresh summons stage. No useful purpose would be served by keeping the matter pending, and any further continuation will impinge upon the right to a speedy trial.

3. Accordingly, the case in C.C.No.98 of 2022 on the file of the Judicial Magistrate Court, Sankarapuram Taluk, Kallakurichi shall stands quashed and consequently, this Suo Motu Transfer Case is disposed of. 08.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.2 of 3
