The petitioner seeks leave to file an appeal against the order dismissing his complaint for non-appearance under Sections 256 and 204 of the Cr.P.C. and consequential acquittal of the respondent.
2. The learned counsel for the petitioner would submit that the complainant was absent only on one occasion; that the case is pending for execution of warrant against the accused; that no notice was issued to the complainant before dismissing the complaint; and that therefore, the order of the trial Court is liable to set aside.
3. The points raised by the petitioner require consideration by this Court and hence, leave is granted to file an appeal.
4. Registry is directed to number the appeal and post for admission, if it is otherwise in order.
