The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6 (4) of TN Scheduled Commodities (RDCS) order, 1982 r/w 7(1) (a) (ii) of Essential Commodities Act, 1955, in Crime No.182 of 2023, on the file of the respondent police seeks anticipatory bail.

2.The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated in the case registered in Crime No.182 of 2023, for the offences under Sections 6 (4) TN Scheduled Commodities (RDCS) order, 1982 r/w 7(1) (a) (ii) of Essential Commodities Act, 1955. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) that on 10.10.2023, at about 21.30 hours, the defacto complainant along with the respondent police were engaged in routine surveillance near Saravanabavan Hotel NH road Subetharmedu. At that time, A1 who is 1/3

the Driver of the vehicle bearing registration No.KA 53 3324 was arrested with 6080 Kgs of PDS rice (152 bags each containing 40 Kgs). A1 had been taken into custody. The vehicle and the PDS rice had been seized. A2 is the petitioner herein. Petitioner is the owner of the vehicle and also said to be the owner of the contraband. Thus, he prayed for dismissal of this petition.

4.In view of that particular fact, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
