This application has been filed to grant leave to the applicant/plaintiff to sue the second respondent/defendant herein under Order XIV Rule 8 of the High Court Original Side Rules read with Order III Rule 1 of the Original Side Rules read with clause 12 of the Letters Patent in the above suit.

Having regard to the allegations in the plaint and entire cause of action arose at Chennai and the agreement also entered in Chennai, though the second defendant is residing outside the jurisdiction of this Court, considering the averments made in the affidavit filed in support of the application, this applications is ordered as prayed for.
