ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 28.11.2020, while the accused was driving a two wheeler bering registration No.TN 52 Z 9960 in a high speed and negligent manner, a dog ran across the road, due to which, when the accused suddenly applied the brakes, the accident occurred and caused injuries. A case was registered in Crime No.1062 of 2020 for the alleged offences under Sections 279 and 337 of the Indian Penal Code, 1860. Page No.1 of 3

3. When the matter was called, the accused was present and pleaded guilty. Considering the overall nature of the accident, the fact that the accused has been facing the case for a long time and that he has now pleaded guilty, this Court is of the view that a penalty of fine of Rs.200/- for the offence under Section 279 of the Indian Penal Code and Rs.300/- for the offence under Section 337 of the Indian Penal Code shall be imposed. The fine amount shall be paid by the accused on the next date of hearing before the Trial Court.

4. Accordingly, the case in S.T.C.No.480 of 2022 of Judicial Magistrate No.1, Erode Taluk, Erode, stands disposed of. This Suo Motu Transfer Case stands disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
